Terms of Service

Strategy Mastery LLC, a New Mexico limited liability company, operates the website https://lacasadelestratega.com and the online training program "Método Solera" under the brand "La Casa del Estratega". These Terms of Service ("Terms") govern your access to and use of the website, program materials, community, live calls, mastermind events, and all related services. Please read them carefully.

1. ACCEPTANCE OF TERMS

By accessing the website, creating an account, enrolling in the program, or using any service offered by Strategy Mastery LLC (collectively, "Services"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services. Your use of the Services constitutes acceptance of these Terms as of the date you first access the website or enroll. We may update these Terms at any time and will notify you of material changes by posting the updated version on the website with a new effective date. Your continued use after such notice constitutes acceptance of the revised Terms.

3. NATURE OF THE SERVICES

Método Solera is an online educational training program, online community platform, weekly live instructional calls, and an annual in-person or virtual mastermind event. The program teaches strategy and business principles for working as a behind-the-scenes strategist for influencers and content creators. The program is educational in nature only.

The Services are not:

• Employment. Enrollment does not create an employment relationship, partnership, or joint venture between you and Strategy Mastery LLC.

• Legal advice. The program does not provide legal services or constitute legal advice. You should consult a licensed attorney regarding any legal matters.

• Financial or investment advice. The program does not recommend investments or provide personalized financial advice. Information provided is educational only. You should consult a licensed financial advisor before making financial decisions.

• Professional services. The program does not substitute for professional services in law, accounting, tax, financial planning, business consulting, or other regulated professions.

You assume full responsibility for implementing any strategies, principles, or techniques taught in the program and for evaluating their suitability for your situation.

4. ELIGIBILITY

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are at least 18 years old, have the legal authority to enter into these Terms, and are not prohibited by law from using the Services. If you are using the Services on behalf of a business entity, you represent that you have authority to bind that entity.

5. ACCOUNT AND ACCESS

When you create an account or enroll in the program, you are granted a personal, non-exclusive, non-transferable license to access the Services for your individual educational use only. Your account is personal to you and may not be shared with, transferred to, or used by another person. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree not to:

• Share login credentials or provide account access to anyone else.

• Resell access to the Services or any program materials.

• Use the Services for any commercial purpose other than your own use as a strategist.

• Grant anyone else the right to access or use your account.

If you discover unauthorized use of your account, notify us immediately at info@lacasadelestratega.com. We reserve the right to suspend or terminate your account if we reasonably believe it has been compromised or misused.

6. FEES, PAYMENT, AND CURRENCY

Pricing for the program is displayed on the website and at checkout. The price, currency, payment plan options, and any applicable taxes are shown to you before purchase. You are responsible for reviewing and confirming the price and terms before completing payment.

Payment is processed by a third-party payment processor selected at checkout. You are responsible for providing accurate payment information. Charges appear on your statement under the payment processor's name. Different payment processors may be available for different customers based on location or payment method.

Taxes, VAT, GST, or other governmental charges applicable to your purchase are your responsibility and are calculated and collected as required by law. Your invoice or receipt will indicate the total amount charged, including any applicable taxes.

If you select a payment plan, the terms (number of payments, amounts, and due dates) are shown at checkout and in your purchase confirmation. You authorize Strategy Mastery LLC and the payment processor to charge the payment method you provide according to the payment plan selected. If a payment fails, we will attempt to collect it again, and you may incur late fees or payment processor fees.

7. CANCELLATION, WITHDRAWAL, AND REFUNDS

Your cancellation and refund rights are governed by our separate Refund Policy. Please review the Refund Policy before purchasing, as it contains specific deadlines, conditions, and procedures.

If you are a consumer located in the European Union, Spain, or another jurisdiction with mandatory consumer protection laws, you may have the right to withdraw from your purchase within 14 calendar days after purchase without penalty. However, this right does not apply to digital content or digital services if you have given your express prior consent to begin performance of the service before the 14-day withdrawal period ends. By enrolling in the Método Solera program and accessing materials or attending live calls, you acknowledge that the service begins immediately upon enrollment and that you have expressly consented to this immediate performance. As a result, you lose your statutory right of withdrawal upon such consent.

Any specific guarantee, warranty of results, or satisfaction guarantee offered by Strategy Mastery LLC appears only in writing at the point of purchase or in the purchase confirmation. No other guarantee or warranty of results is made. If no written guarantee is displayed at checkout or in your confirmation, none exists.

8. INTELLECTUAL PROPERTY

All program materials, including but not limited to videos, audio, written content, transcripts, graphics, designs, worksheets, templates, slides, and all other content created or provided by Strategy Mastery LLC are the exclusive property of Strategy Mastery LLC and are protected by copyright and other intellectual property laws.

You are granted a limited, personal, non-exclusive, non-transferable, revocable license to access and view the materials solely for your individual educational use. You may not:

• Copy, reproduce, or modify the materials.

• Record, screenshot, or capture video or audio content.

• Share, resell, or distribute materials to anyone else.

• Create derivative works based on the materials.

• Use the materials for commercial purposes or to teach others.

• Remove or alter copyright notices or proprietary markings.

Your license terminates immediately if you violate these restrictions or if your account is terminated. Upon termination, you must cease all use of the materials and delete any copies you may have made.

Unauthorized copying, recording, sharing, or resale of program materials violates copyright law and these Terms and may result in account termination and legal action.

9. COMMUNITY RULES AND CONDUCT

Our online community is a space for members to interact, share experiences, ask questions, and support one another. Use of the community is subject to the following rules:

• Be respectful and professional in all interactions.

• Do not post spam, promotional content, or solicitations unless explicitly permitted.

• Do not share program materials outside the community.

• Do not post defamatory, harassing, threatening, or abusive content.

• Do not disclose others' personal information without consent.

• Do not post unlawful content or content that violates others' rights.

Strategy Mastery LLC reserves the right to remove posts, restrict your community access, or terminate your account for violations of these rules or for conduct that disrupts the community. You are solely responsible for the content you post.

10. EARNINGS AND RESULTS DISCLAIMER

Strategy Mastery LLC does not guarantee any specific financial results, earnings, or business outcomes from using the Método Solera program. Past results, testimonials, or examples do not guarantee your results. Results depend on many factors outside Strategy Mastery LLC's control, including your effort, skill, business conditions, market dynamics, and decisions you make.

Any earnings figures, income projections, or income examples presented are illustrative only and should not be interpreted as predictions or guarantees of what you will earn. The program teaches strategies and principles; actual results vary widely and depend on your implementation, market conditions, and other factors.

You are solely responsible for evaluating the program's potential value to you and for assessing the business environment in which you operate. You assume all risk associated with implementing the strategies taught.

11. THIRD-PARTY PLATFORMS AND SERVICES

The website and Services may include links to or integrations with third-party platforms, websites, payment processors, video hosting services, communication tools, and other services. Strategy Mastery LLC does not control these third-party services and is not responsible for their content, performance, security, privacy practices, or availability.

Your use of third-party services is governed by their own terms and privacy policies. You are responsible for reviewing those terms before using such services. Strategy Mastery LLC is not liable for any harm, loss, or damage arising from your use of or interaction with third-party services.

12. DISCLAIMER OF WARRANTIES

The Services are provided on an "as-is" and "as-available" basis. Strategy Mastery LLC disclaims all other warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that:

• The Services will be uninterrupted, error-free, or fully functional at all times.

• All defects will be corrected or that the Services are free of viruses or harmful code.

• The information or materials are complete, accurate, or current.

• The Services will meet your specific needs or expectations.

To the extent permitted by law, all warranties are disclaimed.

13. LIMITATION OF LIABILITY

To the extent permitted by applicable law, Strategy Mastery LLC's total liability to you for any claim arising from or related to these Terms, the Services, or your use thereof shall not exceed the total amount you paid to Strategy Mastery LLC in the 12 months immediately preceding the claim or event giving rise to the claim.

In no event shall Strategy Mastery LLC be liable for indirect, incidental, special, consequential, punitive, or lost profits damages, even if advised of the possibility of such damages.

This limitation applies to all claims regardless of their legal basis, including contract, tort, strict liability, or any other theory.

Notwithstanding the foregoing, this limitation does not apply to:

• Your mandatory consumer rights that cannot be waived by law, including those in the European Union, Spain, and other jurisdictions with mandatory consumer protections.

• Claims for fraud or willful misconduct.

• Any liability that cannot be limited under applicable law.

If you are a consumer subject to mandatory consumer protection laws, those laws remain in full effect and limit our liability as permitted by those laws, even if the limitation in this section is broader.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Strategy Mastery LLC, its owners, employees, agents, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your violation of these Terms.

• Your use of the Services.

• Your violation of any law or third-party rights.

• Any content you post in the community.

• Any action you take based on information provided in the program.

This indemnity does not apply to claims arising solely from Strategy Mastery LLC's gross negligence or willful misconduct.

15. TERMINATION

Your right to use the Services and your account may be terminated or suspended by Strategy Mastery LLC at any time and for any reason, including:

• Violation of these Terms.

• Violation of applicable law.

• Account inactivity for an extended period.

• At our sole discretion, with or without cause.

Upon termination, your access to the Services and program materials ceases immediately. Any fees paid are non-refundable except as required by law or as stated in the Refund Policy.

16. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and your use of the Services are governed by the laws of the State of New Mexico, USA, without regard to conflict of law principles. However, mandatory consumer protection laws in your country of residence also apply and are not waived.

Before initiating any legal action or arbitration, you and Strategy Mastery LLC agree to attempt to resolve any dispute through good-faith negotiation. Contact us at info@lacasadelestratega.com with a detailed description of your dispute and your proposed resolution.

If negotiation does not resolve the matter, any legal action or proceeding must be brought in the state or federal courts located in Bernalillo County, New Mexico, USA. You consent to personal jurisdiction in those courts.

This choice of forum and governing law does not deprive you of mandatory consumer rights or mandatory protections available under the laws of your country of residence, EU law, or other applicable mandatory law. If you are a consumer in a jurisdiction where local mandatory consumer protection laws require that disputes be resolved in local courts or through local procedures, you retain the right to pursue claims in those forums.

17. CHANGES TO THE TERMS

Strategy Mastery LLC may modify these Terms at any time by posting the updated version on the website with a new effective date. You will be notified of material changes. Your continued use of the Services after such notice constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Services.
